China to offer grace period to discredited individuals: Supreme People's Court

China on Thursday issued a guideline allowing local courts to offer a grace period of one to three months for people who have exhibited dishonest conduct. Analysts say this shows the country endeavors to further optimize the regulation of its social credit system and provide more "good faith" in its legal execution.

During the grace period, information about discredited individuals will not be disclosed, according to the Supreme People's Court (SPC). 

If such individuals fail to fulfill the obligations specified in relevant legal documents at the end of the period, information regarding their dishonest behaviors will be released and corresponding disciplinary measures will be taken, according to the court.

Not all cases will allow the new grace period, which will comply with specific situations, consider defaulters' willingness to fulfill their obligations and the degree of their dishonesty, He Dongning, deputy director of the enforcement bureau of the SPC, told a press conference on Thursday.

He noted the guideline offers [discredited individuals] opportunities to correct their wrongdoings, deterring them (from reoffending) and urging them to take the initiative.

The new guideline will urge defaulters to fulfill their obligations while minimizing the adverse impact, industry analysts said.

The guideline also directs that full-time students who embroiled in campus loans will not be discredited, nor restricted in their individual consumption.

Additionally, local courts should temporarily exempt certain defaulters from their travel bans on humanitarian grounds including the serious illness or death of a relative.

Two measures - a blacklist for dishonesty and restrictions on consumption - play a vital role in regulating dishonest behaviors. With the new guideline, their impacts on Chinese people have also become greater, He said. 

As these two systems are relatively new, certain mechanisms still need to be enhanced, He said, adding that precise management needs to be further standardized.
